Terms of Use

1. Agreement to these terms
These Terms of Use are an agreement between you and I Am Black Business, Inc. (“I Am Black Business,” “we,” “us”). They cover iamblackbusiness.com, our business dashboard and the I Am Black Business iPhone app, which Genesis 37 Labs LLC publishes on our behalf (together, the “Service”). By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
2. Who can use the Service
You must be at least 13 years old to use the Service. If you’re under 18, you need a parent or guardian’s permission. To list, claim or pay for a business listing, you must be at least 18 and authorized to act for that business.
3. Your account
Give us accurate information, keep your password secure, and tell us right away if you think someone else is using your account. You’re responsible for what happens under your account. You can delete it at any time, as described in our Privacy Policy.
4. The directory
I Am Black Business helps people discover and support Black-owned businesses. Listings are written by the businesses and people who submit them. We don’t guarantee that any listing is accurate or current, or the ownership, quality, safety or legality of any business or its goods and services. Labels such as “Verified” or “Premium” aren’t endorsements. Your dealings with a business, including any purchase, are between you and that business.
5. Listing and claiming a business
- Only add or claim a business that you own or are authorized to represent, and keep its listing accurate and up to date.
- We may verify a claim, for example by emailing the address on the listing or by reviewing proof you send us. We may approve, reject or reverse a claim, and false claims can lead to removal of the listing or your account.
- We may edit, decline, remove or change the status of any listing, for example if it’s a duplicate, has closed, or doesn’t meet the directory’s purpose.
- Listing a business publicly identifies it as Black-owned. By adding or claiming a listing, you confirm that the business is Black-owned and agree to that being shown publicly.
- You keep ownership of what you submit, such as text, photos and logos, and you confirm you have the right to share it. You give us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, format and distribute it to run and promote the Service, including in search results and on social media. For a listing that stays in the directory, this license continues after you delete your account.
6. Paid plans
- Paid plans, such as business listing plans and Movement Supporter memberships, are billed in advance, monthly or yearly, through our payment processor, Stripe. They renew automatically until you cancel.
- You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period, and you keep the plan’s features until then. If you delete your account and choose to remove a listing, that listing’s plan ends right away. We don’t refund partial billing periods unless the law requires it.
- We’ll give you notice before a price change takes effect, and you can cancel before it does. If a payment fails, we may pause the plan’s features until it’s resolved.
- Purchases made through Apple, if we offer them in the iPhone app, are billed by Apple and follow Apple’s terms and refund policies.
7. Acceptable use
When you use the Service, don’t:
- Break the law, or post anything fraudulent, misleading, harassing, hateful or infringing.
- Impersonate a person or business, or misrepresent your connection to a business.
- Send spam or unwanted messages to businesses through the contact form, or file false reports.
- Scrape or copy the directory in bulk, or create accounts automatically.
- Interfere with the Service, its security, or other people’s use of it.
We may remove content and suspend or close accounts that break these Terms.
8. Our content
The Service, including its design, name and logos, belongs to I Am Black Business and is protected by law. You may use it for your own personal, non-commercial purposes, and for managing your own listings. If you send us feedback or ideas, we may use them without any obligation to you.
9. Other websites and services
The Service links to websites, maps, social media and services that we don’t control, including the businesses’ own sites. We aren’t responsible for them, and your use of them follows their own terms.
10. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the Service. Sections 5, 6 (for amounts already owed), 8, 11 through 15 and 17 continue after your access ends.
11. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don’t promise that the Service will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent the law allows, I Am Black Business won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Service or your dealings with any business listed on it. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived.
13. Your responsibility to us
You agree to defend and compensate I Am Black Business for claims, losses and costs, including reasonable legal fees, that arise from content you submit or from your breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it informally. Any dispute that we can’t resolve will be decided in the state or federal courts in Fulton County, Georgia, and you and we agree to their jurisdiction.
15. The iPhone app
Your license to the I Am Black Business iPhone app itself comes from Apple’s Licensed Application End User License Agreement. These Terms cover your use of the Service through the app. In addition:
- These Terms are between you and us, not Apple. Apple isn’t responsible for the Service or its content and has no obligation to provide support for it.
- We, not Apple, are responsible for any claims about the Service, including product liability, legal compliance, consumer protection and intellectual property claims.
- You must also follow the App Store’s terms when using the app.
16. Changes to these terms
We may update these Terms. We’ll change the effective date above, and if a change is significant, we’ll tell you on the website or in the app, or by email, before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
17. General
These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don’t enforce a part of these Terms right away, we haven’t given up the right to. You may not transfer these Terms to anyone else. We may transfer them, including to an affiliated company or a successor to our business.
